Roses Only website is owned and operated by Roses Only & Lush Flowers Pty Ltd (Australian Business Number: 60 065 255 692). By accessing, browsing or using this website, you agree to the terms, conditions and disclaimers herein as amended from time to time. By purchasing an item advertised on this website and/or by completing the registration process to become a member of Roses Only ("a Member"), you agree to be bound by these Terms and Conditions. Roses Only may amend these Terms and Conditions from time to time and any amendment will become effective immediately. Your continued use of this website after amendment constitutes an agreement to abide by and be bound by those Terms and Conditions, as amended.

Trademarks, Copyrights and Restrictions
All material on this site, including, but not limited to images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by Roses Only, its related companies or by other parties that have licensed their material to Roses Only. Material on rosesonly.com or any Web site owned, operated, licensed or controlled by Roses Only is solely for your personal, non-commercial use. Such material may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of Roses Only. Use of the materials on any other Web site or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of Roses Only copyrights, trademarks and other proprietary rights, and is prohibited.

The use of this website and these conditions shall be governed by and construed in accordance with the laws of Australia. Any legal action arising out of its use shall be brought and enforced under the laws of Australia. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia.

Refunds
As each flower is unique, so too, are your special requirements and concerns surrounding your order. For that reason, we ask that you please call our Customer Service Department on 1300 767 376 (Option # 3) to discuss any queries or concerns you may have in relation to the flowers you have sent or received. A number of resolutions may be available to you and are subject to your particular situation.
Note: All refunds for orders placed online or over the telephone are credited back the original credit card on which the order was purchased. In-store refunds are only processed through our head office and will not be issued in-store. A voucher to the same amount paid will be issued for all cash purchases.

Fraud
Any party engaged in illegal activities involving the use of this website will be subject to civil and criminal sanctions and prosecution. Roses Only does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website.  It is an illegal violation to place orders under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. All persons found to have placed a fraudulent order will be prosecuted.

GST (Goods & Services Tax)
Our products and services attract a Goods and Services Tax (GST) of 10%. All prices advertised are inclusive of all taxes applicable to the respective countries that the product is being delivered in. This is a broad based tax on consumption, which applies to the supply of most goods and services. 

Currency
All prices on rosesonly.com.au are listed in Australian dollars (AUD).

Alcohol
All alcoholic products offered for sale by Roses Only are NOT available to persons under the age of 18 years.

Substitutions:
Substitutions may be necessary to ensure your arrangement or specialty gift is delivered in a timely manner. The utmost care and attention is given to your order to ensure that it is as similar as possible to the requested item.

• Flowers
  In arrangements of assorted flowers, the colors shown online will be used if at all possible, even if this means substituting other kinds of flowers of equal or greater value. For one-of-a-kind flower arrangements, such as all roses or all lilies, we will make every attempt to match the flower type, but may substitute with another color. If the floral container shown online is not available, a similar container will be used.
• Specialty gifts
  Specialty gifts may be substituted with another specialty gift of equal or greater value and of similar theme and category.
  

Refunds
Should you need to cancel your order, money will be refunded less a $15 administrative fee, ONLY IF notice is received by Roses Only 24 hours prior to the scheduled delivery date. Cancellations received with less than 24 hours notice will be charged at 50% of the total order value. We are unable to cancel orders that are already prepared and are with our courier for delivery.

Delivery

Prices on our website do not include delivery charges.  Standard Delivery Fee of $9.50 applies now to all Australian delivered locations. Depending on your delivery location and time of ordering, additional delivery charges may apply. Delivery charges will be calculated at check out at the time of ordering and displayed on the ordering page.

Terms used on our websites
Standard Delivery:  means delivery within our Roses Only Delivery Network, delivered to MOST business addresses by 5pm and MOST residential addresses by 7pm. GENERALLY your order must be placed by 10am on the desired day of delivery in order for it to be sent on our Standard Delivery service. Conditions may apply for this as it largely depends on the distance of your desired delivery location. Generally, we charge $9.50 Standard Delivery Fee to most Australian locations but this may vary again, depending on the distance and time of order.

Roses Only Gift Certificates
1. This voucher is redeemable by the bearer for Roses Only merchandise to the value stated on the front of this voucher.

2. This voucher is redeemable at the prices for Roses Only merchandise applying at the time of redemption of the voucher.

3. Please note that a minimum purchase value of $69 is applicable which is exclusive of delivery charges. In the instance where this voucher is for complimentary Roses Only merchandise, this clause does not apply.

4. This voucher is only valid for delivery within the specified Roses Only delivery network. For further information on the Roses Only delivery network please call 1300 767 376.

5. This voucher cannot be used in conjunction with any other Roses Only promotion or discount offer or with the Roses Only membership discount. Only one discount will apply per order and it will be the larger discount of the two.

6. There is a limit of one voucher per order.

7. Roses Only will not accept responsibility or be liable for vouchers that are lost or stolen.

8. This voucher may not be used after the expiry date stated on the front of this voucher and is not exchangeable, refundable, replaceable or redeemable for cash or payment of accounts.

9. This voucher may only be redeemed on our website at rosesonly.com toward the purchase of Roses Only merchandise online; in store at any Roses Only location; or via phone on 1300 767 376.

10. For orders placed on our website at rosesonly.com, the voucher discount will be applied once the order has been submitted.

11. This voucher can be redeemed only once. Roses Only will not redeem this voucher if, on presentation, our records indicate that this voucher or a voucher bearing the same reference number as that displayed on this voucher has already been redeemed or has not been issued.

12. The value of this voucher may not be applied after a transaction is made. If forgotten, the voucher must be saved and used towards your next purchase.

13. Gift Certificate orders placed out of business hours will be posted on the next business day.

14. Roses Only accepts gift certificates delivered by post to Australian Addresses only. 

eVouchers
1. eVouchers are exchangeable by bearer for merchandise or services.

2. It is redeemable off a minimum purchase of $79 and valid only for delivery within the specified Roses Only Delivery Network.

3. eVouchers may not be used in conjunction with any other promotion, discount offer or with the Roses Only membership discount.

4. eVouchers are non replaceable.

5. Roses Only and eVoucher.com will not be liable for any lost or stolen eVoucher.

6. eVouchers may not be used after its expiry date and are not exchangeable, transferable or redeemable for cash or payment of accounts.
